CRIMINAL LAW, EVIDENCE AND PROCEDURE - ARREST AND DETENTION - ARREST - ARREST WITHOUT WARRANT - FOR BREACH OF THE PEACE - WHAT AMOUNTS TO BREACH OF THE PEACE - ACTS AMOUNTING TO BREACH OF THE PEACE BREACH ON PRIVATE PREMISES
Notes
This case establishes that breach of the peace can occur on private premises even where no members of the public outside the premises are involved.
Obviously this could be used against activists who were attempting to gain access to private premises, especially if there had been a disturbance there previously.
